GENERAL CONDITIONS OF SALE
pursuant to Chapter I, Title 3, Part 3, of Legislative Decree 206/2005, as amended and supplemented
Summary
1. Introduction
These General Terms and Conditions of Sale (hereinafter referred to as the ‘General Conditions’) govern the remote sale of products and services made available via the internet on the website www.vignematte.it (hereinafter referred to as the ‘Site’) and the related payment and delivery, in compliance with Italian regulations as per Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter referred to as the ‘Consumer Code’).
The seller of the products and owner of the Site is: Società Agricola Vigne Matte Srl (VAT no. 03636520268), with registered office at Via Tea No. 8, 31030 Rolle (TV) – Email address info@vignematte.it.
The person who accesses the Site to make purchases (hereinafter “Customer”) is required, before sending the order, to carefully read these General Conditions – which constitute a binding agreement – made available to them on the Site and which will be available to the Customer at any time through the link contained in the confirmation email of each order, allowing them to reproduce and store it.
In the event that the purchaser on the Site requests the issuance of an invoice and/or is not a ‘consumer or user’ as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the provisions on withdrawal set forth in Article 6 of these General Conditions shall not apply, nor, more generally, shall the provisions that, pursuant to the same Consumer Code, apply solely to ‘consumers.’
Contracts concluded with Società Agricola Vigne Matte Srl through the Site are governed by these General Conditions in compliance with Italian law.
The characteristics and price of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.
To purchase Products, the Customer must complete and submit the order form in electronic format, following the instructions provided on the Site. The Customer must add the Product to the Cart and, after reviewing these General Conditions and the Privacy Policy and confirming acceptance, enter the shipping and, if applicable, billing information, select the desired payment method, and confirm the order.
By sending the order from the Site, which constitutes a contractual proposal, the Customer acknowledges and declares that they have read all the instructions provided during the purchase procedure and fully accept these General Conditions and payment terms, as well as the Privacy Policy.
The contract concluded between Società Agricola Vigne Matte Srl and the Customer shall be considered finalized upon acceptance of the order by Società Agricola Vigne Matte Srl. This acceptance will be communicated to the Customer through an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing information, a list of the Products ordered with their essential characteristics, the total price—including delivery costs—and the payment method used. The Customer must review the confirmation email, and if any errors are identified in the order (such as billing or shipping address, contact information, or similar), they will have a fixed timeframe of 24 hours from the receipt of this email to contact Società Agricola Vigne Matte Srl by email or phone. After this period, the order will be processed for shipment, and no further modifications will be accepted.
Upon receiving the order, Società Agricola Vigne Matte Srl reserves the right to check the actual availability of the ordered products; if one or more Products are not available, Società Agricola Vigne Matte Srl will proceed with replacing the Product with a similar one.
In the case of one or more missing products, Società Agricola Vigne Matte Srl will not charge for the corresponding amount. If payment for the order was made by bank transfer, the refund will be processed using the same payment method.
2. Products Sold on This Site
This site sells items directly produced by Società Agricola Vigne Matte Srl.
Upon ordering, products are carefully packed in secure packaging and shipped via courier.
Photos are indicative, and labels may vary from those shown on the site.
The items listed in the catalog are always available; in case of unavailability of one of the ordered products, we will promptly contact you. You can cancel the order and receive an immediate refund of the amount paid or modify the order by including available items for delivery.
2.1 Voucher
On this site, it is possible to purchase Vouchers through which the buyer can gift tasting sessions at the Vigne Matte winery.
The Vouchers have variable amounts depending on the number of people who can participate in the tasting: 40 Euros for 2 participants; 80 Euros for 4 participants; 100 Euros for 5 participants.
The Vouchers are valid for one year from the date of purchase. The reservation by the Voucher recipient is subject to the availability of the winery and must, in any case, be made at least 10 days before the tasting date.
If the recipient cannot attend the tasting on the reserved date, they may cancel the reservation with at least 48 hours’ notice; if this notice period is not respected, the Voucher will be considered used and non-redeemable. If at least 24 hours’ notice is given, the recipient may use it for a new reservation (always with at least 10 days’ notice before the tasting date). The second reservation cannot be canceled, and if the recipient cannot attend the tasting, the Voucher will be considered used and non-redeemable.
The Voucher cannot be redeemed for cash and must be presented upon arrival at the winery on the day of the tasting.
3. Territorial Limitation to Italy
Products are sold exclusively to individuals residing in Italy and are delivered only within Italian territory.

Payment is made via the secure PayPal site, a leader in online payments. Your Credit Card details will not be transmitted to the winery in any way.

Payment reference: The Customer must include the order ID and the first and last name of the order holder in the bank transfer reference, which can be found in the confirmation email.
6. Shipping
Products purchased on the Site are delivered to the address indicated by the Customer during the purchase procedure in the appropriate field.
Normally, the order is carefully packed, shipped within 2-3 business days from the actual receipt of payment in the bank, and delivered by the courier within 4-5 business days on the mainland and within 5-7 business days on the islands.
7. Right of Withdrawal
Internet sales of our products are identified as distance contracts (i.e., concluded outside commercial premises) and are therefore governed by Legislative Decree No. 206/05 (Articles 50 to 68).
You have the right to withdraw from the purchase contract for any reason, without needing to provide explanations or incur any penalty. To exercise this right, you must—within 14 working days from the date of receipt of the goods—simply send a written communication to ‘Società Agricola Vigne Matte Srl’ to that effect and then proceed with returning the purchased goods. The only condition we set is that the goods must not have been opened or damaged.
You may return the items using the method most convenient for you (mail, courier, etc.); returned products should be sent to: Società Agricola Vigne Matte Srl, Via Tea No. 8, 31030 Rolle (TV).
Once the products are received, we will immediately initiate the refund procedures.
The right of withdrawal is governed by the following conditions:
- The right applies to the Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts, it is not possible to exercise the withdrawal on only part of the purchased Product.
- In the event of exercising the right of withdrawal, Società Agricola Vigne Matte Srl will refund the customer the full amount of the returned goods within 14 days from the date the withdrawal notice is received, while reserving the right to withhold the refund until the goods are actually received. The refund will be made using the same payment method used by the Customer for the order, unless they have expressly requested a different method. The refund will be processed within 10 working days from the acceptance of the return by Società Agricola Vigne Matte Srl. In the case of a bank transfer, the Customer is responsible for providing the bank details required for the refund (account holder, bank name and address, IBAN). In this case, the refund will be made within 10 working days of receiving all necessary information for the payment. The credit will appear in the Customer’s account shortly afterward, according to the timing provided by the selected payment method or the bank.
- Products must be returned in the same box they were received in.
- In addition to the cases indicated in the Preliminary Statements (non-consumer customer and/or customer requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree 21/2014:
- Order of Products made to measure or clearly personalized;
- Order of Products that are liable to deteriorate or expire rapidly;
- orders of sealed Products that are not suitable for return due to health protection or hygiene reasons or that have been opened after delivery. In cases where the right of withdrawal is excluded, Società Agricola Vigne Matte Srl will return the Products purchased and returned by the Customer, charging the latter for the reshipping costs, or dispose of them if necessary.
8. Errors and Liability Limitations
The information related to the Products provided on the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Società Agricola Vigne Matte Srl cannot be held liable, except in cases of willful misconduct or gross negligence.
Società Agricola Vigne Matte Srl reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent, or to change or update the information at any time without prior notice, without prejudice to the rights of the Customer under these General Conditions and the Consumer Code.
Except in cases of willful misconduct or gross negligence, any right of the Customer to compensation for damages or to the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or partial fulfillment of an order.
Società Agricola Vigne Matte Srl promotes the responsible consumption of alcohol and excludes any liability on its part, except in cases of willful misconduct or gross negligence, in the event of a purchase made by persons under the age of 18. By purchasing any alcoholic product, you declare that you are of legal drinking age, as per Article 7 of Legislative Decree 158/2012. Società Agricola Vigne Matte Srl assumes no responsibility if a purchase is made by individuals under 18 who have falsely declared their age.
9. Online Dispute Resolution (ODR)
Pursuant to Article 14 of Regulation 524/2013, users are informed that in case of a dispute, they may file a complaint via the European Union’s ODR platform accessible at the following link: https://ec.europa.eu/consumers/odr/. The ODR platform serves as an access point for users who wish to resolve disputes arising from online sales or service contracts out of court.
10. Applicable Law and Jurisdiction
The sales contract between the Customer and Società Agricola Vigne Matte Srl is deemed concluded in Italy and governed by Italian law. For disputes relating to the interpretation, execution, or termination of these General Conditions or individual purchase orders, if the Customer is a consumer as defined by the Consumer Code, the exclusive jurisdiction lies with the court of their place of residence or domicile if located within Italian territory; in all other cases, exclusive jurisdiction is assigned to the Court of Treviso, with any other competent court excluded.
