GENERAL CONDITIONS OF SALE
Pursuant to Chapter I, Title 3, Part 3, of Legislative Decree 206/2005 and subsequent amendments and integrations
Summary
1. Introduction
These General Conditions of Sale (hereinafter, “General Conditions”) govern the distance selling of products and services made available through the internet on the website www.vignematte.it (hereinafter, the “Site”) and the related payment and delivery, in compliance with Italian law pursuant to Legislative Decree 206/2005 and subsequent amendments and integrations (hereinafter, “Consumer Code”).
The seller of the products and owner of the Site is: Società Agricola Vigne Matte Srl (VAT No. 03636520268), with its registered office at Via Tea No. 8, 31030 Rolle (TV) – Email address: info@vignematte.it.
The person who accesses the Site to make purchases (hereinafter “Customer”) is required, before sending the order, to carefully read these General Conditions – which constitute a binding agreement – made available to them on the Site and which will be available to the Customer at any time through the link contained in the confirmation email of each order, allowing them to reproduce and store it.
If the person making purchases on the Site requests an invoice and/or is not a “consumer or user” as defined in Article 3, Paragraph 1, Letter a), of the Consumer Code, the provisions on withdrawal set out in Article 6 of these General Conditions or, more generally, the provisions that pursuant to the same Consumer Code apply only to “consumers” will not apply.
Contracts concluded with Società Agricola Vigne Matte Srl through the Site are governed by these General Conditions in compliance with Italian law.
The characteristics and price of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.
To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained on the Site. The Customer must add the Product to the Cart and, after viewing and accepting these General Conditions and the Privacy Policy, enter the shipping and billing details, select the desired payment method, and confirm the order.
By sending the order from the Site, which constitutes a contractual proposal, the Customer acknowledges and declares that they have read all the instructions provided during the purchase procedure and fully accept these General Conditions and payment terms, as well as the Privacy Policy.
The contract between Società Agricola Vigne Matte Srl and the Customer is to be considered concluded with the acceptance of the order by Società Agricola Vigne Matte Srl. This acceptance is communicated to the Customer through an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing details, a list of the Products ordered with their essential characteristics, the total price – including delivery costs – and the payment method used. The Customer must check the confirmation email, and if they find any errors in the order (billing or shipping address, contact information, or similar), they have a set time limit of 24 hours from the receipt of the email to contact Società Agricola Vigne Matte Srl via email or phone. After this period, the order will be processed for shipment, and no changes will be accepted.
Upon receiving the order, Società Agricola Vigne Matte Srl reserves the right to check the actual availability of the ordered products; if one or more Products are not available, Società Agricola Vigne Matte Srl will proceed with replacing the Product with a similar one.
If one or more products are unavailable, Società Agricola Vigne Matte Srl will not charge the corresponding price. If the order payment was made via bank transfer, the refund will be processed using the same payment method.
2. Products Sold on This Site
This site sells items directly produced by Società Agricola Vigne Matte Srl.
Upon ordering, products are carefully packed in secure packaging and shipped via courier.
Photos are indicative, and labels may vary from those shown on the site.
The items listed in the catalog are always available; in case of unavailability of one of the ordered products, we will promptly contact you. You can cancel the order and receive an immediate refund of the amount paid or modify the order by including available items for delivery.
3. Territorial Limitation to Italy
Products are sold exclusively to individuals residing in Italy and are delivered only within Italian territory.

Payment is made through the secure PayPal site, a leader in online payments. Your Credit Card details will not be transmitted to the winery.

Reference: The Customer must indicate the order ID and the name and surname of the order holder in the transfer reference, as found in the confirmation email.
6. Shipping
Products purchased on the Site are delivered to the address indicated by the Customer during the purchase procedure in the appropriate field.
Normally, the order is carefully packed, shipped within 2-3 business days from the actual receipt of payment in the bank, and delivered by the courier within 4-5 business days on the mainland and within 5-7 business days on the islands.
7. Right of Withdrawal
Internet sales of our products are identified as distance contracts (i.e., concluded outside commercial premises) and are therefore governed by Legislative Decree no. 206/05 (Articles 50 to 68).
You have the right to withdraw from the purchase contract for any reason, without providing explanations and without penalties. To exercise this right, you must – within 14 business days from the date of receipt of the goods – simply send a written communication to “Società Agricola Vigne Matte Srl” and then return the purchased goods. The only condition we impose is that the goods have not been opened or damaged.
To return the products, you can use the most convenient method (post, courier, etc.); returned products should be sent to: Società Agricola Vigne Matte Srl, Via Tea No. 8 31030 Rolle (TV)
Once the products are received, we will immediately initiate the refund procedures.
The right of withdrawal is governed by the following conditions:
- The right applies to the Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts, it is not possible to exercise the withdrawal on only part of the purchased Product.
- In case of exercising the right of withdrawal, Società Agricola Vigne Matte Srl will refund the customer the full amount of the returned goods within 14 days from the date the withdrawal notice is received, subject to Società Agricola Vigne Matte Srl’s right to suspend the refund payment until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer for the order, unless the Customer has expressly requested a different method. The refund will be made within 10 business days from the acceptance of the refund by Società Agricola Vigne Matte Srl. In case of a bank transfer, the Customer must provide the bank account details for the refund (account holder, bank name and address, IBAN). In this case, the refund will be made within 10 business days from the receipt of all necessary information for the transfer. The credit back to the Customer’s account will occur in a short time, according to the timing provided by the selected payment method or the bank.
- Products must be returned in the same box they were received in.
- Besides the cases mentioned in the Introduction (non-consumer customer and/or requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree: 21/2014:
- Order of Products made to measure or clearly personalized;
- Order of Products that are liable to deteriorate or expire rapidly;
- Order of sealed Products that are not suitable for return for health protection or hygiene reasons and have been unsealed after delivery. In cases of exclusion of the right of withdrawal, Società Agricola Vigne Matte Srl will return the Products purchased and returned by the Customer, charging the Customer for the shipping costs, or dispose of them where necessary.
8. Errors and Liability Limitations
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, which Società Agricola Vigne Matte Srl cannot be held responsible for, except in cases of willful misconduct or gross negligence.
Società Agricola Vigne Matte Srl reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent, or to change or update the information at any time without prior notice, without prejudice to the rights of the Customer under these General Conditions and the Consumer Code.
Except in cases of willful misconduct or gross negligence, any right of the Customer to compensation for damages or to the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or partial fulfillment of an order.
Società Agricola Vigne Matte Srl promotes the responsible consumption of alcoholic beverages and excludes any liability on its part, except in cases of willful misconduct or gross negligence, in the event of purchases made by minors under the age of 18. By purchasing any alcoholic product, you declare to be of legal age as per Article 7 of DL 158/2012. Società Agricola Vigne Matte Srl assumes no responsibility in case of purchases made by minors under 18 who have declared a different age.
9. Online Dispute Resolution (ODR)
Pursuant to Article 14 of Regulation 524/2013, users are informed that in the event of a dispute, they may submit a complaint via the ODR platform of the European Union, accessible at the following link: https://ec.europa.eu/consumers/odr/. The ODR platform serves as a point of access for users who wish to resolve disputes arising from online sales or service contracts extrajudicially.
10. Applicable Law and Jurisdiction
The sales contract between the Customer and Società Agricola Vigne Matte Srl is concluded in Italy and governed by Italian law. For the resolution of disputes related to the interpretation, execution, or resolution of these General Conditions or individual purchase orders, if the Customer is a consumer under the Consumer Code, the jurisdiction is exclusively that of their place of residence or domicile if located in Italian territory; in all other cases, the exclusive jurisdiction is that of the Court of Treviso, excluding any other competent court.
